Terms of Service

1. Agreement
By creating an account or using any part of the Studify platform operated by Studify Pty Ltd, you agree to these Terms of Service and our Privacy Policy. If you do not agree, do not use our services.
These terms govern the relationship between Studify and: Students (individuals seeking study-abroad placements), Agents (licensed education consultants), and Institutions (universities and colleges).
2. Account registration
- You must be at least 16 years old to create an account.
- You are responsible for maintaining the confidentiality of your credentials.
- You must provide accurate, current, and complete information during registration.
- You may not share your account or create multiple accounts for the same person.
- You must notify us immediately at legal@studify.au if you suspect unauthorised access to your account.
- Agent and institution accounts require an activation code issued by Studify.
3. Use of the platform
Permitted use
- Students: browse courses, apply to institutions, manage applications, communicate with agents.
- Agents: manage student leads and applications, communicate with institutions and students, issue invoices.
- Institutions: list courses, review and process applications, manage agent accreditations.
Prohibited conduct
You must not:
- Submit false, misleading, or fraudulent information in applications or documents.
- Impersonate another person or organisation.
- Attempt to gain unauthorised access to other accounts or systems.
- Reverse-engineer, scrape, or otherwise extract data from the platform without written consent.
- Use the platform to send spam, phishing messages, or unsolicited commercial communications.
- Upload content that is unlawful, defamatory, obscene, or infringes third-party rights.
- Circumvent, disable, or interfere with platform security features.
- Use the AI features to generate fraudulent documents or misrepresent your qualifications.
4. Platform fees and payments
- Students use Studify free of charge. Institutions pay Studify a commission upon student enrolment.
- Agents may subscribe to a paid plan granting access to CRM features, SMS/email credits, and AI tools. Subscription fees are billed monthly or annually as chosen at sign-up.
- Institutions pay a commission rate agreed at onboarding. Commission is payable within 30 days of a student's enrolment confirmation.
- All fees are in Australian Dollars (AUD) unless otherwise stated. Prices are inclusive of GST where applicable.
- Subscription plans auto-renew unless cancelled before the renewal date. Cancellation takes effect at the end of the current billing period; no refunds are issued for partial periods.
- We reserve the right to change pricing with 30 days' notice. Continued use after the effective date constitutes acceptance.
5. AI features
- AI-generated content (SOPs, recommendations, visa predictions) is provided as a starting point only and does not constitute professional legal, visa, or academic advice.
- You are solely responsible for reviewing and verifying AI-generated content before submitting it to institutions.
- Submitting AI-generated content as entirely your own original work to institutions may violate their academic integrity policies — review each institution's requirements.
- AI credits are non-refundable once consumed. Credits expire at the end of your subscription period.
6. Intellectual property
- The Studify platform, brand, and all content created by Studify are our intellectual property protected by Australian and international copyright law.
- You retain ownership of content you upload (documents, SOPs, photos). By uploading content, you grant Studify a limited, non-exclusive licence to use it solely for providing our services to you.
- You must not copy, reproduce, or distribute platform content without prior written consent.
7. Disclaimers and limitation of liability
- Studify facilitates connections between students, agents, and institutions. We do not guarantee admission, visa approval, scholarship grants, or employment outcomes.
- Course information (fees, requirements, intakes) is provided by partner institutions and may change without notice. Always confirm details directly with the institution.
- The platform is provided "as is" and "as available." We do not warrant uninterrupted or error-free operation.
- To the maximum extent permitted by applicable law, Studify's total liability to you for any claim is limited to the fees you paid to Studify in the 12 months preceding the claim.
- We are not liable for indirect, incidental, special, consequential, or punitive damages.
- Nothing in these terms excludes liability for fraud, death, or personal injury caused by our negligence, or any liability that cannot be excluded under Australian Consumer Law.
8. Termination
- You may delete your account at any time via Account Settings → Delete Account.
- We may suspend or terminate your account immediately if you breach these terms, engage in fraudulent activity, or for any reason with 14 days' notice.
- On termination, your access to the platform ceases. Data is handled as described in our Privacy Policy.
9. Governing law and disputes
These terms are governed by the laws of New South Wales, Australia. Any dispute that cannot be resolved informally will be submitted to binding arbitration under the ACICA Arbitration Rules, seated in Sydney.
If you are a consumer in the EEA or UK, you may also raise a dispute via your local consumer protection authority or the EU Online Dispute Resolution platform.
10. Changes to these terms
We may update these terms to reflect changes in our services or applicable law. We will provide at least 14 days' notice of material changes by email. Continued use after the effective date constitutes acceptance.
